    Fitness Girl,

    You need a LAWYER, Immediately!

Contact your certifying agency to see if they can recommend one that is close to you.

You also need insurance! I know it won't help now, but you've got to get some before this woman gets you to court, or you will not get insured by any agency for a reasonable price.

Make sure you have copies of everything your client signed and all the routines you put her through.

If she filled out an HHQ and indicated she had some pre-existing condition that may help. But you really need a lawyer.

    GOOD LUCK!!

fitnessgirl, it sounds like you have no choice but to ask an attorney for legal advice. I am sorry you are going through this. From what I understand waivers do not mean a whole lot. I do not say this to scare you but you really need to talk to a lawyer. On the bright side, I would think it would be very difficult for her to prove that YOU caused HER injury. Remember, she has to prove her case. This isn't a case where you dropped a dumbbell on her head and you are clearly at fault. Also, her history of bad checks/non-payment says a lot about her character.

Who are you certified through? I agree with Dave. Contact your certifying agency and maybe they can give you some direction.

DO NOT let her lawyer bully you. Do not do ANYTHING until you consult your own attorney.

Best of luck. Keep us posted.

    NOT TO EVERYONE AND SELF:

Keep your insurance and certs up to date!

Yeah speak to lawyer - it may cost you a few hundred bucks up front - but I know in New York we have provisions against frivolous lawsuits - where if she's really in the wrong, you can go back after her - this should warn her to back the f off -

    Right on, Kaiser.

By the way, do you want to hear something sad? I actually saw that Judge Judy episode on television a while back.
